PRIVACY POLICY
Information on the Processing of Personal Data

Fondazione Costa Crociere and Costa Crociere S.p.A. (hereinafter also jointly “Costa Crociere”), as data controller, pursuant to Art. 13 of the General European General Data Protection Regulation 679/2016 (hereinafter “GDPR”), provide the following information regarding the processing of personal data that you, as a data subject, have communicated to us:
a) during registration and participation in projects;
b) as part of your relationship with the Fondazione Costa Crociere;
c) registration on the Fondazione Costa Crociere website.

Purpose and legal basis of data processing

 

a) Purpose relative to the management of donations. Your personal data shall be processed in order to allow Costa Crociere Foundation to manage the donations received, specifically for:

(i) the assignment of certain goods that Costa Crociere Foundation wishes to donate;

(ii) the execution of our projects;

(iii) responding to your requests.

The legal basis for the processing of data is the implementation of the relationship between you, as the donor, and Costa Crociere Foundation, as resulting from your donation.

 

b) Legal purposes and protection. Your personal data shall also be processed to:

(i) execute legal obligations, regulations, national and community rules, and rules deriving from provisions issued by authorities legitimated to do so by law and which constitute the legal basis for this data processing;

(ii) ascertain, exercise and/or defend a legal right of Costa Crociere Foundation in court. The legal basis for the processing of data is the pursuit of the legitimate interests of Costa Crociere Foundation and/or third parties (e.g. in the event of disputes).

 

c) Purposes relative to business and statistics. Your personal data shall also be processed for purposes relevant or pertinent to activities carried out by Costa Crociere Foundation and, specifically, for the anonymous processing of aggregated statistics. In this case, your consent is not needed as the required processing shall be carried out with anonymous data.

 

d) Newsletter subscription for updates on our activities. Additionally, with your express consent, your personal data shall be processed to communicate information to you relative to Costa Crociere Foundation’s projects, and communications concerning newly available goods that the Foundation intends to donate.

 

The legal basis for the processing of data is your express consent, which you may revoke anytime.

 

e) Email communications relative to projects you donated to. The legal basis for the processing of data is Costa Crociere Foundation’s legitimate interest in ensuring transparency for its donors on the progress of projects and initiatives, as well as your legitimate interest in being updated on the progress of the project for which you made your donation.

 

In any case, you may cancel your subscription anytime and discontinue the aforementioned communications by clicking on the appropriate link available in each email sent by Costa Crociere Foundation.

 

This request shall not affect the mailing of our newsletters, as mentioned at point “d” above, provided you have expressed consent.

 

Categories of recipients of personal data.
Your data will not be disclosed. Your data may only be used for the purposes stated above and may only be disclosed to the following categories of subjects:

  • internal staff of Costa Crociere, as data processor(s);
  • companies belonging to the same Group of Companies as Costa Crociere, including those located abroad;
  • persons, companies, associations or professional firms that provide services or assistance and consulting to Costa Crociere in order to protect the rights thereof (for example, accountants, doctors, attorneys, tax advisors, auditors, and/or consultants in the field of auditing operations or due diligence, etc.);
  • persons, companies, or agencies that provide marketing and analysis services or consultancy activities to Costa Crociere;
    subjects whose right to access the data is recognised by legal and is in accordance with regulatory provisions or by provisions issued by authorities legitimised by the law.

Transfer of personal data outside the European Union.

Your personal data may be transferred abroad to third-party companies belonging or not belonging to the European Union, always for the purposes indicated above.
In case of data transfer to countries outside of the European Union, these countries will guarantee an adequate level of protection based on a specific decision of the European Commission or alternatively the recipient will be contractually obliged to protect the data with an appropriate level, comparable to the protection provided by the GDPR.

Personal data retention.

Personal data will be retained for a period not exceeding that which is necessary to achieve the purposes for which it was collected and subsequently processed. Personal data will be kept for the entire duration of the relationship with the Fondazione Costa Crociere and including for a subsequent period:
i. within the terms established by current legislation;
ii. within the terms established by regulations, according to which, data retention is required (for example, tax returns);
iii. within the period of time necessary to protect the rights of the data owner, in the event of any disputes related to the delivery of the service.

Data subject’s rights.

At any time, pursuant to Articles 15 to 22 of the GDPR, you have the right, including in relation to profiling activity, of:
a) access your personal data;
b) requesting the correction of your personal data;
c) withdrawing, at any time, your consent to the use and disclosure of your personal data;
d) requesting that your personal data is deleted;
e) receiving your personal data in a structured, commonly used, machine-readable format, and transmitting your personal data to another data controller;
f) oppose the processing of personal data concerning you, including for marketing or profiling purposes;
g) obtaining limitations on the processing of your personal data;
h) lodging a complaint with a supervisory authority;
i) receiving a communication if there is a violation of personal data;
j) requesting information regarding:

  1. the purposes of the processing
    ii. the categories of personal data
    iii. the recipients or categories of recipients to whom the personal data have been or will be communicated, in particular if the data is transmitted to recipients in third-party countries or international organisations and the existence of appropriate safeguards;
    iv. the retention period of the personal data
    v. where the personal data is not collected from the data subject, any available information regarding its origin;
